§ 17½-1. Regulation of cable television systems.

  • (a)

    The Parish of Rapides, State of Louisiana, (hereinafter, "parish") is a franchising authority with the legal authority to adopt, and the personnel to administer, regulations with respect to the rates and charges of any cable television system operating in the parish including, without limitation, the systems currently being operated by Vision Cable of Alpine, a service of Al-Pine Cable TV, Inc., and Galaxy Cablevision (herein "companies") pursuant to the cable franchise agreement.

    (b)

    The parish desires to regulate the basic service rates and charges and associated equipment of the companies and other cable television systems operating in the parish and shall do so in accordance with The Cable Consumer Protection and Competition Act 1992 and rules and regulations adopted pursuant thereto by the Federal Communications Commission (FCC), which are included herein by reference, notwithstanding any inconsistent provisions in the franchise agreement. In connection with such regulation, the parish will ensure a reasonable opportunity for consideration of the views of interested parties.

    (c)

    The president or his designee is authorized to execute on behalf of the parish the FCC such certification [sic] and other forms as are required by the FCC rate regulations in order to enable the parish to regulate rates and charges.
