§ 19-68. Enforcement.

  • (a)

    Before taking any enforcement action under this article, a police officer shall ask the apparent offender's age and reason for being in the public place. The officer shall not issue a citation or make an arrest under this article unless the officer reasonably believes that a violation of this article has occurred and that, based upon any response and other circumstances, no defenses in section 19-67 are present.

    (b)

    In lieu of issuing a curfew citation or making an arrest of a minor in violation of any provision of this article, a police officer may issue a citation under the FINS Act (Ch. C. art 730 et seq.) or take any other action permissible under the FINS Act.
